ARC Rental Subscription \u2013 Terms and Conditions<\/strong><\/p>\n\n\n\n

These Terms and Conditions (\u201cTerms\u201d) govern the rental subscription service for the ArcEquine\/Arc4Health device (\u201cDevice\u201d) provided by ARC MICROTECH LTD<\/strong> (\u201cCompany\u201d, \u201cwe\u201d, \u201cus\u201d, or \u201cour\u201d). By subscribing to the ArcEquine\/Arc4Health rental service, you agree to these Terms.<\/p>\n<\/div>\n\n\n\n

2. Rental Service<\/strong><\/p>\n\n\n\n

The ArcEquine\/Arc4Health rental service provides customers with use of an ArcEquine\/Arc4Health device for a recurring subscription fee.<\/p>\n\n\n\n

The Device and kit provided remains the property of the Company at all times<\/strong>.<\/p>\n\n\n\n

Your subscription includes:<\/p>\n\n\n\n

    \n
  • Use of the ArcEquine\/Arc4Health device, charger and accessories<\/li>\n\n\n\n
  • Ongoing subscription billing<\/li>\n\n\n\n
  • Customer support<\/li>\n<\/ul>\n\n\n\n

    The Device must not be sold, transferred, sub-rented, or otherwise disposed of by the customer.<\/p>\n\n\n\n

    <\/p>\n\n\n\n

    3. Subscription and Payment<\/strong><\/p>\n\n\n\n

    Your rental operates as a recurring subscription<\/strong>.<\/p>\n\n\n\n

    By subscribing you authorise us to charge your payment method through Stripe<\/strong> automatically.<\/p>\n\n\n\n

    Billing details:<\/p>\n\n\n\n

      \n
    • Billing cycle: Weekly (after initial 8 week period)<\/li>\n\n\n\n
    • Subscription price: \u00a3165 upfront payment, then \u00a315 per billing cycle<\/li>\n\n\n\n
    • Payments are charged automatically until cancellation.<\/li>\n<\/ul>\n\n\n\n

      If payment fails we may:<\/p>\n\n\n\n

        \n
      • retry payment,<\/li>\n\n\n\n
      • suspend service,<\/li>\n\n\n\n
      • or request return of the Device.<\/li>\n\n\n\n
      • if payment fails we will raise a weekly invoice for the subscription price, and failure to either return the rental or settle the invoice(s) will result in debt collect proceedings.<\/li>\n<\/ul>\n\n\n\n

        We reserve the right to change subscription pricing with 30 days notice<\/strong>.<\/p>\n\n\n\n

        <\/p>\n\n\n\n

        <\/p>\n\n\n\n

        4. Minimum Rental Period<\/strong><\/p>\n\n\n\n

        The minimum rental period is 8 weeks from the date the Device is delivered. If you cancel before the minimum period ends, no refund or partial refund of the upfront rental fee will be issued.<\/p>\n\n\n\n

        5. Shipping and Delivery<\/strong><\/p>\n\n\n\n

        Devices will be shipped to the address provided during checkout. Delivery times are estimates only and may vary. Customers are responsible for ensuring the delivery details are correct.<\/p>\n\n\n\n

        Risk of loss passes to the customer upon delivery.<\/p>\n\n\n\n

        <\/p>\n\n\n\n

        <\/p>\n\n\n\n

        6. Customer Responsibilities<\/strong><\/p>\n\n\n\n

        You agree to:<\/p>\n\n\n\n

        • Use the Device only as instructed.<\/li>\n\n\n\n
        • Keep the Device in good working condition.<\/li>\n\n\n\n
        • Not modify, open, repair, or tamper with the Device.<\/li>\n\n\n\n
        • Notify us immediately if the Device is damaged, lost, or stolen.<\/li>\n\n\n\n
        • Not sell, transfer, sub-rent, or otherwise dispose of the Device.<\/li>\n\n\n\n
        • Keep all personal and bank details updated<\/li>\n<\/ul>\n\n\n\n

          The ArcEquine Device must be used only for equine therapy purposes<\/strong>. The Arc4Health Device must be used only for human therapy purposes.<\/strong> <\/p>\n\n\n\n

          <\/p>\n\n\n\n

          <\/p>\n\n\n\n

          7. Damage, Loss, or Non-Return<\/strong><\/p>\n\n\n\n

          You are responsible for the Device while it is in your possession.<\/p>\n\n\n\n

          If the Device is:<\/p>\n\n\n\n

            \n
          • lost<\/li>\n\n\n\n
          • stolen<\/li>\n\n\n\n
          • damaged<\/li>\n\n\n\n
          • not returned after cancellation<\/li>\n<\/ul>\n\n\n\n

            we may charge the replacement value of the Device (\u00a3280)<\/strong> to your payment method.<\/p>\n\n\n\n

            <\/p>\n\n\n\n

            <\/p>\n\n\n\n

            8. Cancellation<\/strong><\/p>\n\n\n\n

            You may cancel your subscription by contacting support or through your customer account.<\/p>\n\n\n\n

            Cancellation takes effect at the end of the current billing period<\/strong>, provided the minimum rental period has passed.<\/p>\n\n\n\n

            <\/p>\n\n\n\n

            Upon cancellation:<\/p>\n\n\n\n

              \n
            1. We will issue return instructions.<\/li>\n\n\n\n
            2. The Device must be returned within 5 working days<\/strong>.<\/li>\n<\/ol>\n\n\n\n

              If the Device is not returned within this period, additional charges may apply.<\/p>\n\n\n\n

              <\/p>\n\n\n\n

              <\/p>\n\n\n\n

              9. Returns<\/strong><\/p>\n\n\n\n

              Customers must return the Device:<\/p>\n\n\n\n

                \n
              • in reasonable condition<\/li>\n\n\n\n
              • with all accessories included.<\/li>\n<\/ul>\n\n\n\n

                Return shipping instructions will be provided upon cancellation. We recommend using tracked shipping.<\/p>\n\n\n\n

                10. Consumer Rights<\/strong><\/p>\n\n\n\n

                Nothing in these Terms affects your statutory rights under UK law, including your rights under the:<\/p>\n\n\n\n

                • Consumer Rights Act 2015<\/strong><\/li>\n\n\n\n
                • Consumer Contracts Regulations 2013<\/strong><\/li>\n<\/ul>\n\n\n\n

                  You may have a 14-day cooling-off period<\/strong> from delivery during which you may cancel your subscription and return the unused Device.<\/p>\n\n\n\n

                  11. Liability<\/strong><\/p>\n\n\n\n

                  To the maximum extent permitted by law:<\/p>\n\n\n\n

                  • We are not liable for indirect or consequential losses.<\/li>\n\n\n\n
                  • Our total liability shall not exceed the total amount paid by you in the previous 12 months.<\/li>\n<\/ul>\n\n\n\n

                    Nothing limits liability for:<\/p>\n\n\n\n

                    • death or personal injury caused by negligence<\/li>\n\n\n\n
                    • fraud or fraudulent misrepresentation.<\/li>\n<\/ul>\n\n\n\n

                      12. Medical Disclaimer<\/strong><\/p>\n\n\n\n

                      The ArcEquine device is intended for equine therapy support only<\/strong>. It is not a substitute for veterinary diagnosis or treatment. Always consult a qualified veterinarian for medical concerns.<\/p>\n\n\n\n

                      The Arc4Health device is intended for human therapy support only<\/strong>. It is not a substitute for medical diagnosis or treatment. Always consult a qualified practioner for medical concerns.<\/p>\n<\/div>\n\n\n\n

                      13. Privacy<\/strong><\/p>\n\n\n\n

                      Your personal data will be processed in accordance with our Privacy Policy. Payment data is securely processed by Stripe<\/strong> and we do not store full card details.<\/p>\n<\/div>\n\n\n\n

                      14. Changes to These Terms<\/strong><\/p>\n\n\n\n

                      15. Governing Law<\/strong><\/p>\n\n\n\n

                      Rental service only available to customers with a UK billing and shipping address.<\/p>\n<\/div>\n\n\n\n
